dcs takes children from epileptic mom

I am the grandmother of two beautiful young girls, 5 and 18 months. My 22 yr old daughter is an epileptic and their mother. My daughter and her girls were living with us and have been for a while.When the baby was 2mos old she started with a cough.Within 24hrs she was breathing very labored and i told her to take her to the ER. When they did the chest x-ray,they said she had two “healed” broken ribs and the possibility of two more, but they wouldn’t be able to tell for two more weeks.DCS was called and agent Kama Grund came to investigate.She insisted that the baby was physically abused with old and new breaks to the ribs.When she was told that my daughter had fallen with her while having a siezure,while nursing,she said that didn’t cause it, it was due to sqeezing.Well what does she think can happen during a siezure. My daughter suffers from three types of siezures. She has petimal, and granmal which she can either lay out and shake or curl up in the fetal position.The time in question, was a granmal in the fetal position, which made her fall out of the chair, and the baby had to be pryed out of her arms. Kama  Grund said she didn’t buy it nor did the doctor.So at that point the children were both removed, one for abuse and the 5yr old for neglect even though the medical report on her was was that she was happy, healthy, with no signs of abuse.When I was contacted the next day by Kama, she would not answer any of my questions and kept threatening to terminate the call but it was none of my business, even though the alleged abuse took place in my home. She also told us not to show up to court with our daughter and when we did we were physically kept out of the court room by two sheriffs and then escorted out of the building and told not to return unless ordered by the court.When we did not go the next time she was told by her “court appointed atty”that if she didn’t sign the CHINS she would not get her children back.That she just needed to do as they say and this would all be over in a few months.She did and now 15 mos later all they want to do is terminate her rights because she can’t find a good enough job to support her and the girls with no help from anyone else,and that she hasn’t gotten a home on her own.Why should this matter.She was living with us before they were taken and continued to until the judge ordered her out so that we could have the girls in our custody instead of being in fostercare with strangers who after 4 mos already had sights on adopting them.Also the two new breaks turned out to not be breaks at all.They don’t know what they are.Then why couldn’t the other calcium build ups be just that, calcium buildups.We have never been allowed still with the chidren in our care ever been able to have copies of the medical records or x-ray as they are under a legal hold by DCS.When my daughter had her baby, she was living with us so she didn’t have to work, so she could take care of her girls.We had no idea of how frequently or with what force her seizures were going to come back after the baby was born.They were under control before this.But we did seek medical attention to try to get them back under control.We ahd put safety steps in place by not leaving her alone for any length of time,not making her work and just in general taking care of her as most families due with a sick child.But DCS did not want to hear this so they made me choose between my grandchildren and my sick daughter.Now DCS want us to adopt them.This is so stupid to not give her the time she needs to get well and her seizures under control.I also think it falls under discrimination but all the atty’s I have talked to are basically afraid of DCS and say there is nothing they can do.We go to court on Aug.27.I jsut wish someone had some advice on how to get the judge to not grant the termination at this time,and allow my daughter to move back in with us so I can take care of my family once again.My daughter has unlimited supervised visitation so why can’t she live with me.Anyway this is my story.Please pray for us.

    That is just a terrible story to read and very sad. It also makes me so mad that there are attornies out there that are so afraid of DCS that they won’t do anything to assist. What a bunch of spineless cowards! If I were an attorney right now I would take them on in a minute and not back down for a second. I would be the type of attorney that loathes and despises CPS,DCS or whatever their name is this week. It looks to me , that the baby has Osteogenisis Imperfecta, or brittle bone disease and should be checked out for that. It easily is mistaken for abuse but people who don’t know a thing about these genetic problems.
