CPS Offers up Blackmail and Extortion in Plea Deal
This morning, around 9:30 am, I received notice from my new legal council that CPS has put an offer on the table to settle my case. CPS and the state of Montana have stated that if I agree to sign Temporary Legal Custody of my children over to the department and agree to an, as of yet, undisclosed, Family Service Plan that my children will be allowed to return home by the end of the week. However, if I should refuse this plea deal, my children will not be allowed to return home and will be removed from their kinship care placement with my cousin and be placed elsewhere as the department sees fit.
This is clearly Blackmail and Extortion as defined by federal statutes. My children are being used as bartering tools and my parental rights and signature as payment, with the clear threat of continuing to hold my children hostage. This would also constitute ransom and bribery as defined by federal statutes.
These crimes are punishable by prison time of 1 year per offense as well as fines up to 50,000 per offense.
Now it doesn’t surprise me in the least that CPS and the state of Montana have made this offer of Blackmail and Extortion, as I have read several accounts of this type of behavior and talked to many parents who have experienced this as well. What does surprise me is the fact that CPS thinks that they can continue to offer Blackmail and Extortion as a plea deal, and that they thought I would, not only, bite but allow it.
I wonder what the judge will think?

You should contact you U.S. House Representative and request and official investigation. This action is probably nothing new for the judge — many of them are just as corrupt as the CPS flunkies, who are trying to blackmail you.
Put them on the offensive and make them squirm.

It doesnt sound as if you would take this deal but just in case I strongly urge you NOT to. I am not a lawyer but I’m a parent that has been through the ringer in the “system”. I have heard so any horror stories of deals being offered just like this one. They will promise your children home but then will say “Your Honor this person did not follow their family plan!” Even though you did. To the letter. That is exactly what happened to me. Fight them. Fight them with all of your resources. y parental rights were stipped because I thought if I just played their game and cooperated with them then my child would come home. I underestimated them. Now I am paying for it.

I have contacted my house of representatives and they no longer deal with state issues. I’m still waiting to hear form the governor.
I will not sell my children or myself out to blackmail and extortion. On Monday my CPS worker called to inform me that there will be no meeting for a ‘family service’ plan because there are no concerns. However, they still refuse to return my children. Court is in 2 weeks, my children and I will win. I will accept nothing less.
fightingforjessy,
I hope you appealed your case. Keep taking it to court over and over again. Keep a journal with dates and events, this could be your strongest source of evidence. I’m not a lawyer either, not yet, but I will be. Soon when CPS looks across the court room it will be me defending people like those of us who have been seriously wronged by the ‘system’. If they think they don’t like me now….
Any way, stay strong. Your little one needs you to be strong. You will be in my thoughts and please know you are not alone, many of us walk with you.
